ACCEPTANCE OF TERMS: By accessing, logging into, or utilizing the software ecosystem provided by Kriday Web Tech Solutions, you explicitly acknowledge that you have read, understood, and agreed to be legally bound by the terms and policies outlined in this document.

1. Definitions and Roles

For the purposes of this agreement, the following definitions apply:

Provider: Kriday Web Tech Solutions, the vendor and developer of the software infrastructure.
Distributor: The registered Mutual Fund Distributor (MFD) or authorized entity subscribing to the Provider's software to manage and track their clients' mutual fund portfolios.
End-Client: The investors whose financial transaction data is managed by the Distributor using the software.

2. Data Privacy & Zero-Monetization Policy

The Provider strictly adheres to a zero-monetization data policy. We categorically state that we do not sell, rent, trade, or redistribute the personal, financial, or transactional data of either the Distributor or the End-Client to any third-party marketing firms, data brokers, or external entities. Data is housed on our servers exclusively for the functional purpose of rendering portfolio valuations and reporting services.

3. Consent and Data Storage

All data processed by the software is hosted on secure servers with the explicit permission of the Distributor. By utilizing this software, the Distributor confirms that they operate within the regulatory framework and possess the necessary consent from their End-Clients to upload, process, and store their transaction data within the Provider's ecosystem.

4. Data Sovereignty and Right to Deletion

We believe in absolute data sovereignty. The Distributor retains full ownership and control over their data and their respective End-Clients' data.

Distributor Access: Distributors are equipped with administrative controls allowing them to independently delete any End-Client's data, portfolio, or profile directly from their dashboard at their sole discretion.
Complete Account Purge: Upon a formal written request by the Distributor, the Provider commits to permanently deleting and erasing the Distributor’s entire database and all associated End-Client records from our primary servers.

5. Security Protocol & Limitation of Liability

The Provider has implemented robust, industry-standard security protocols, including parameterized queries, secure database architecture, and encrypted transmission channels to protect data integrity against unauthorized access.

However, no digital system is entirely impervious to systemic risks. By using this software, the Distributor and the End-Client acknowledge and agree to the following Liability Waiver:

Force Majeure & Cyber Threats: While the Provider utilizes highly secure systems, the Provider shall not be held legally or financially liable for data breaches, data loss, or unauthorized access resulting from sophisticated cyber-attacks, zero-day exploits, server hardware failures, or acts of cyber-terrorism beyond reasonable control.
Distributor Indemnity: The Distributor shall not be held liable by the End-Client for systemic breaches that occur at the server level, provided the Distributor has maintained secure credential management.
Account Security: The Distributor is solely responsible for maintaining the confidentiality of their login credentials. The Provider is not responsible for data exposure resulting from compromised passwords or unauthorized device sharing by the Distributor or End-Client.

6. Mutual Protection Clause & Regulatory Disclaimer

This software operates strictly as an intermediary technology platform (Software as a Service). The Provider merely acts as a technology vendor facilitating data aggregation and reporting.

Regulatory Disclaimer: The Provider does not offer investment advisory services, execute trades, or handle direct client funds. The software does not provide recommendations to buy or sell any financial products.

Protection of the Provider: The Distributor assumes full responsibility for the accuracy of the data fetched and reported. The Provider is indemnified against any legal disputes arising between the Distributor and the End-Client regarding investment performance, reporting discrepancies, or financial losses.

Protection of the Distributor: The Provider ensures that the software architecture restricts cross-pollination of data. An End-Client mapped to a specific Distributor is securely siloed and remains the exclusive proprietary business relationship of that respective Distributor.

7. Amendments to the Policy

Kriday Web Tech Solutions reserves the right to modify or update this Privacy Policy periodically to reflect technological advancements or regulatory requirements. Continued use of the software following any such changes constitutes your consent to such modifications.
